Following a review of home education legislation in 2003, a new Act was passed by parliament in August 2006. Yet, an estimated 80% of Queensland homeschoolers still aren’t registered. Since the development of the Home Education Unit and new registration process, few families who previously did not have dispensation have decided to become legal homeschoolers.

Homeschooling in Queensland
This article describes how compulsory education laws in Queensland prescribe that all children of a certain age-range receive instruction from a teacher who is formally qualified and registered as such in Queensland. The article argues that many families have ended up in a legal vacuum – Queensland’s Education Act is likely to be found invalid, if challenged in the High Court or with the United Nations, but the Queensland Government avoids such a challenge. The article concludes that this situation should end and that such laws should be terminated.
Home schooling in Queensland is not well understood. It is seen by many as either a social or educational aberration pursued by a small minority of fringe groups within the community, or as a manifestation of parental neglect. This perception is no different to most other parts of Australia.
