Disclaimer: Throughout this series, we will be using the term “Special Needs” because that is the term that most people who are searching the Internet will use to find information. We fully understand that using any term used to categorize children may result in generalizations that may not apply to every child, stigmas associated with that term, and the possibility of overlooking the many beautiful positive traits that exist when we look at the whole child. We celebrate the differences that make us unique individuals and learners, and we write everything in this series with the hopes of benefiting all children and their families.

Homeschooling can help a wide array of children, including students with special needs. The ability to work one-on-one with a child and provide the specialized instruction and care that a child needs is often cited as a reason for homeschooling. Parents recognize that customized education can help their child thrive and grow. Homeschooling a child with special needs allows a parent the ability to cut through red tape, create their own schedule, and focus on their child’s interests. 

Still, there are many who question if parents can (or should) homeschool their child with special needs and the legality in doing so. It is essential to understand your state’s homeschool law and the special education rights and responsibilities that your child has. The fact is that homeschooling is legal in every state and, in some cases, even homeschooled children can gain access to special education from their local school. Want to know more? Be informed! Federal Special Education Rights and Responsibilities

Special needs law can be confusing, but understanding it is crucial to making sure you receive the special education rights to which you are entitled. The Individuals with Disabilities Education Act (IDEA) was enacted in 1975. This law ensures free appropriate public education to eligible children with disabilities throughout the nation. IDEA also ensures special education and related services to those children. However, this federal act doesn’t always ensure services to homeschooled children. Individual state laws are in place as well and dictate who can use the support services of the state. You need to look at Federal vs. State Laws to fully understand your rights as a family.

 

Special Needs Law by State 

Under the Child Find Mandate, federal law requires all states to test and evaluate homeschooled children who may need special education. It is, however, up to the individual state whether to require students to attend public school to receive additional support services.
